Party Wall Service


The Party Wall etc. Act of 1996 establishes the legal framework for preventing and resolving disputes over party walls, boundary walls, and excavations near neighbouring buildings/structures. A 'party wall' is more than just the boundary between two properties; it also includes:


  • A wall is part of one structure but is on the boundary line of two or more properties.
  • A wall connects two or more properties, such as when someone builds a wall and then a neighbour builds something next to it.
  • A garden wall is a wall that is astride or butts up against the boundary line and is used to separate properties but is not part of any building.
  • Excavation near a neighbour's house.
  • Flat floors and ceilings

Building owners who intend to carry out work covered by the Act must notify adjoining owners of their intentions in the manner prescribed by the Act. Adjoining property owners may agree or disagree with the proposal. When they disagree, the Act provides a mechanism for appointed surveyors to resolve disputes. The Act's requirements are distinct from the need to obtain planning permission, building regulation approval, and, in the case of leaseholders, a license to alter.
